General terms and conditions of sale

Article 1 - General

These general terms and conditions of sale of the company JABADOR.COM define the rights and obligations of the parties in the context of the sale of products by Jabador.com to customers of the Jabador.com Site.
The Member declares that it has read and accepted the rights and obligations relating thereto.

Any order made on the services is governed by these terms and conditions.

 

Article 2 - Terms of order and prices

You have the possibility to order via https://www.jabador.com

The customer guarantees that he is fully entitled to use his payment card or PayPal account for the payment of his order.
By clicking on the "Checkout" button during the ordering process, and after having checked the contents of the order in his "Shopping Cart", the customer declares that he accepts the present General Conditions of Sale.

After confirming the content of the order, the customer will validate it definitively by payment. The order will only be definitive once the corresponding price has been paid. Jabador.com will confirm the order and then dispatch it by email.
The price indicated for each product is inclusive of all taxes (all taxes included) and the shipping costs will be indicated before the final validation of the order.

 

Article 3 - Availability of products

You can only order our items that are in stock.

You have the possibility to make a pre-order for products that are no longer in stock, which does not commit us to anything, you will be notified by email as soon as the product is available again.

 

Article 4 - Right of withdrawal

If you are not completely satisfied with the product(s) purchased, you have 14 days from the date of receipt of your package to cancel your order and return it to us. It goes without saying that any item worn will not be reimbursed under any circumstances.

Any return of damaged product will incur a penalty according to the damage caused.

Any claim made after this period will be rejected without possibility of appeal. For this you must imperatively :

Inform us of your decision by contacting customer service contact@jabador.com on the day you receive the package.

Return the new items in the original packaging, undamaged, with all accessories at your expense to the following address

The refund of the article will be made within 15 days.

 

Article 5 - Payment

Payment for purchases can be made by credit card via Stripe or PayPal.
The payment cards accepted to date are: CB, Visa, MasterCard.
The order will be considered effective after confirmation of the agreement of the bank payment centres.

The entire payment process is carried out between you and Stripe or Paypal. During the payment phase by credit card, you temporarily leave our site.

This is the guarantee that Jabador.com will never know your card number, and that the payment organization will not know anything about the details of your purchases since only the total amount and the order number are transmitted.

The payment can also be made by bank transfer, in this case your order will be reserved three days to allow you to send us the transfer. You will receive by email the details of our bank (RIB), once the provisions on our account your order will be confirmed.

 

Article 6 - Delivery

Orders are prepared upon receipt of payment and are delivered to the address indicated by the customer.
All our items are in stock and are delivered within 3 to 4 days (This period may be longer for shipments outside France).

If you are absent when you present your parcel, a delivery note will allow you to collect it at the post office counter or at a relay point.

Shipping costs are applied according to your place of residence and the weight of your items.

The quality of the packaging makes it very unlikely that a package will be damaged. If this is the case, you can refuse it: the Post Office will return the damaged package and we will send you a new identical package.

When an order is dispatched, Jabador.com warns that an original invoice including delivery costs and VAT is available online on the Website under the heading "My Account".

In the event of late delivery, the customer can contact Jabador.com customer service by writing to contact@jabador.com.

 

Article 7 - Guarantees

Legal warranty (1641 and following of the civil code)

7.1 Jabador.com undertakes either to reimburse the customer for the price of the product, or to exchange the customer's product for a product according to available stocks, or to exchange a product for a product of equivalent quality and price according to available stocks in the event of delivery of a non-conforming product (article 4 above) and in the event of delivery of a product revealing a hidden defect.

For any such request, the customer should contact Customer Service by Email at contact@jabador.com.

These provisions are not exclusive of the right of withdrawal defined in Article 4 above.

7.2 - For all our custom-made products, the right of withdrawal cannot be applied, in accordance with the provisions of Article L 121-20 of the Consumer Code as amended by Order No. 2001-741 of August 23, 2001, which stipulates that the withdrawal period is seven (7) days, and withdrawal is excluded (Article 121-20.2 3rd paragraph) for contracts for the supply of goods that are clearly personalized or made according to the consumer's specifications, in particular, for custom-made and non-standard items. Thus, no withdrawal period will be granted for custom-made items (specific sizes...), for all non-standard items and for items with specific additions or modifications.

Article L211-4 French Consumer Code

The Seller shall be obliged to deliver goods in conformity with the contract and shall be liable for defects in conformity existing at the time of delivery, as well as for defects in conformity resulting from packaging, assembly instructions or installation when the latter has been charged to the Seller by the contract or has been carried out under the Seller's responsibility.

Note: Ordinance 2005-136 2005-02-17 art. 5: The provisions of this Ordinance shall apply to contracts concluded after its entry into force.

Article L211-5 Consumer Code To be in conformity with the contract, the goods must :

1° - Be fit for the use usually expected of a similar good and, where applicable :

- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model

- have the qualities that a buyer can legitimately expect, taking into account public statements made by the seller, the producer or his representative, in particular in advertising or labelling

2° - Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the knowledge of the seller and accepted by the latter.

Note: Ordinance 2005-136 2005-02-17 art. 5: The provisions of this Ordinance shall apply to contracts concluded after its entry into force.

Article L211-12 Consumer Code

Any action resulting from lack of conformity shall be time-barred after two years from the date of delivery of the goods.

Article 1641 Civil Code

The seller is bound by the warranty on account of hidden defects of the thing sold which render it unfit for the use for which it is intended, or which diminish this use so much that the buyer would not have acquired it, or would only have paid a lower price for it, if he had known about them.

Article 1648 paragraph 1 Civil Code

The action resulting from redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.

 

Article 8 - Modification of the general conditions of sale

Jabador.com reserves the right to change these Terms and Conditions.

 

Article 9 - Personal data

Jabador.com only collects the data necessary for the proper processing of customer orders.

All this information is not given to third parties:

- The information you provide when filling out various forms (newsletter subscription, online purchase registration, order placement, contact).

- Information about your equipment (IP address, operating system, your browser type...).

All the data collected allows us to make you benefit from special offers and to inform you continuously about changes and improvements of our offers and services.

In accordance with the law on data processing and freedom of 6 January 1978, you have the right to access, rectify and oppose any personal data concerning you. If you do not want your details to be used elsewhere, you must let us know by mail (or by e-mail) indicating your name, first name, e-mail and full address.
